KINDKUDOS MOBILE APPLICATION PRIVACY POLICY

PLEASE READ THIS KINDKUDOS MOBILE APPLICATION PRIVACY POLICY WHICH IS PART OF THE KINDKUDOS MOBILE APPLICATION TERMS OF USE (“TERMS OF USE”) CAREFULLY. ANY TERMS DEFINED IN THE TERMS OF USE SHALL HAVE THE SAME MEANING IN THIS PRIVACY POLICY. THIS PRIVACY POLICY PERTAINS TO YOUR ACCESSING AND USING THE SERVICE, INCLUDING BY DOWNLOADING OR USING THE KINDKUDOS MOBILE APPLICATION.

The Service is operated by Kind Kudos, Inc. (“We” or “Us”). This policy describes the information collected during registration for and through Your use of the Service, how We use it, how We share it, how We protect it, and the choices You can make about Your information.

In addition to photos and videos taken through the Service, We may access Your photos and videos that are stored on Your mobile device. We may also access information contained in Your address book when you begin to send a message. When You send or receive messages, We also collect, process, and store the contents of those messages (such as photos, text captions, audio recordings, and videos) on our servers. We cannot prevent others from making copies of Your user content (e.g., by taking a screenshot).
      • Any other information You voluntarily provide Us including Your comments and other content in connection with using the Service.
    2. We automatically collect other information about You and/or about Your device, including:
      • Your Internet Protocol (IP) address and mobile device information (e.g., Kindkudos mobile application device ID, device serial number, device type, device manufacturer, and MAC address);
      • The Service features that You use and the time of Your use; and
      • Aggregated information that cannot be used to specifically identify You when You use the Service.
    3. We may collect information about You from third party sources.
    4. We may combine all of the information We collect from or about You and use it in the manner described in this Privacy Policy.
  2. How We Use Your Information

      We use the information that We collect for several purposes, including:

    • The purposes for which You provided it;
    • To process and respond to Your inquiries;
    • To fulfill Your requests;
    • To identify You as a user of the Service;
    • To send You information about Your relationship with Us;
    • To develop new products and services;
    • To personalize and enhance Your experience using the Service;
    • To send push notifications through the Service;
    • To send periodic emails and contact You with information, including promotional information, that We believe will be of interest to You.

For example, Nexmo, Inc. provides certain services to enable text messages to be sent through the Service. Its privacy policy can be found at https://www.nexmo.com/privacy-policy/. We may share information about You that these third parties need to perform their functions and in accordance with our agreements with them.
      • Third Parties for Their Direct Marketing and Other Promotional Purposes. We may share Your information with third parties, including our advertisers, for their direct marketing and other promotional purposes and so that they can provide services for You. Some of these parties may track Your activities over time and across different websites.
    2. Business Changes. If We become involved in a merger, acquisition, sale of assets, joint venture, securities offering, bankruptcy, reorganization, liquidation, dissolution, or other transaction or if the ownership of all or substantially all of our business otherwise changes, We may share or transfer Your information to a third party or parties in connection therewith.
    3. Subsidiaries and Affiliates. We may also share Your information with our subsidiaries and affiliates for purposes consistent with this Privacy Policy. Our subsidiaries and affiliates will be required to maintain that information in accordance with this Privacy Policy.

      Analytics. We use third-party analytics tools to help Us measure traffic and usage trends for the Service. These tools collect information sent by Your device or the Service and other information that assists us in improving the Service. This information may be used to, among other things, analyze and track data, determine the popularity of certain content, and better understand Your online activity.

      For example, We use Google’s Universal Analytics in connection with the Service. Google Analytics collects and stores information from users of the Service, such as an identifier that helps Google determine which ads it has served to other mobile applications on your device, location-based data, Internet Protocol address, type of operating system used, device ID, User ID, Application pages visited and time spent on each Application page and in total Google may track you over time and across websites and apps.

  4. Cookies, Other Storage, Web Beacons, and Other Technologies

    We, along with third parties, use cookies, other storage, Web beacons, and other technologies. These technologies are used for tracking, analytics, and personalization and optimization of the Service.

    1. Cookies. Cookies are small bits of information that are transferred to and stored in separate files within Your device’s browser. You can instruct Your browser to stop accepting cookies. If You do not accept cookies, You may not be able to use all portions or all functionality of the Service.

    2. Closing Your Account. You may close Your account by deleting the application from your device. If the email account or phone number associated with Your account is not active, We may close Your account without notice.
    3. Email Communications. You can make changes regarding receiving email communications from us by clicking the “Unsubscribe” button at the bottom of every email.

  9. Information Collected From Other Websites and Mobile Applications, and Do Not Track Policy

    Your browser or device may offer You a “Do Not Track” option, which allows You to signal to operators of websites, Web applications, mobile applications and services (including behavioral advertising services) that You do not wish such operators to track certain of Your online activities over time and/or across different websites or applications. Our Service does not support DO Not Track requests at this time, which means that We or our analytics providers or other third parties with which We are working collect information about Your online activity both during and after Your use of the Service.

    We do not knowingly collect personal information from individuals under age 13. If You are under the age of 13, please do not submit any personal information through the Service.
